NLRB Judge Axes Additional Workplace Rules at Tape Manufacturer

An adhesive tape manufacturer must rehire the president of a workers’ union after a National Labor Relations Board judge found the company maintained a number of illegal workplace rules.

Intertape Polymer Corp. should rehire the worker because its underlying policies used to sack him were unlawful, said NLRB Administrative Law Judge Arthur Amchan in a decision Monday.

The ruling was issued on remand from the full board, which held in August 2024 that the company’s rules against being on the premises outside of a shift, distributing written material, and posting notices or signs violate federal labor law.

But the board remanded consideration of five other directives back to Amchan to be evaluated under the Biden board’s Stericyle, Inc. precedent. Amchan had previously issued his ruling under the standard set in Boeing Co. a decision from the board made during President Donald Trump’s first administration.

Amchan said in his ruling Monday that he would be considering the remanded rules under the old framework “given the likelihood that Boeing will again be the controlling precedent when this case again comes before the board.”

He held the company’s rules on bringing cameras into the workplace and challenging orders from supervisors infringed on workers’ rights. Others, like prohibiting inappropriate behavior and leaving the plant without permission, are lawful, the judge said.

The president of the employees’ union, Matthew Rose, was fired in 2022 after he posted public notices of grievances that had been filed and other union literature.

Along with rehiring Rose, Intertape must rescind the unlawful workplace policies, Amchan said.
